Currently, the Federal Estate tax rate is 40%. The Applicable Exclusion Amount is $11 million per person. Florida does not have an estate tax. However, Minnesota is decoupled from the Federal Estate Tax and has an current exemption of $3 million per person. Without proper estate planning techniques in place at the time of death, the Minnesota estate planning exemption for married couples may be lost for the first spouse to die.
